This report has been prepared for the African Commission “the Commission”) in its Universal Periodic Review of the Republic o Kenya (“Kenya”). We present new research alongside a summary of redible, publicly available evidence, demonstrating systemic violation by Kenya of its obligations under the African Charter on Human an Peoples’ Rights (“the Charter”). These violations have been carrie out in the context of unlawful internal security operations targetin Somali refugees and asylum seekers, involving the refoulement of Somali efugees and asylum seekers from Kenya to the Republic of Somalia “Somalia”). In particular we focus on refoulements occurring betwee March and May 2014 in the context of an internal security operation called “Operation Usalama Watch.”
